Although it’s common to use the term ‘legal separation’ in Canada, the term confuses some people. Here are the facts you need to know about separating from your spouse:
You are considered legally separated when you live apart from your spouse or offer documentation that proves you lead separate lives (particularly financially).
Your separation period can be indefinite, lasting a few months, a year, or several years, depending on individual circumstances.
You must file for divorce if you intend to remarry; otherwise, you have the option of continuing your legal separation without filing for divorce.
You need to be separated for a full year in order to ask for divorce; however, you can file for a divorce immediately upon separation. There are exceptions in cases of cruelty or adultery. Ask your lawyer for clarification.
